Terms of service

1. Acceptance
By clicking "I agree" or otherwise accessing The Makerwell ("TMW," "Service") at themakerwell.com, you ("you," "User") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Made Market LLC, a Tennessee limited liability company ("we," "us," "our," "Company").
2. Eligibility
You must be at least 18 years old and able to form a binding contract under U.S. law. If you use TMW on behalf of a business or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.
3. Account creation and security
You must provide accurate information when creating your account. You are responsible for safeguarding access to your account, including your magic-link email. You agree to notify us promptly of any unauthorized access.
4. Your content
"Your Content" means all data, text, images, files, and other materials you submit to TMW (your maker profile, products, photos, customer lists, etc.).
You retain all rights in Your Content. You grant us a limited license to host, store, reproduce, display, and process Your Content solely as needed to operate the Service for you (including caching, backups, and serving your public maker page if you've configured one).
You are solely responsible for Your Content. You represent that you have all rights necessary to submit Your Content and that it does not infringe any third party's rights.
5. Acceptable use
You agree NOT to:
- Use the Service for any unlawful purpose
- Upload content that infringes intellectual property, violates privacy, or is defamatory, harassing, or hateful
- Attempt to access another user's account or data
- Reverse engineer, scrape, or extract data from the Service in bulk except your own data via available export tools
- Use the Service to send unsolicited commercial communications
- Misrepresent your maker products (e.g., reselling mass-produced goods as handmade)
- Interfere with the Service's operation or other users' use of it
6. Subscriptions and fees
TMW offers free and paid tiers. Pricing for paid tiers is published at themakerwell.com/pricing. Paid subscriptions auto-renew unless cancelled before the next billing cycle. We may change pricing with at least 30 days' notice. Refunds are at our discretion except where required by law.
7. Marketplace integrations
TMW may integrate with third-party platforms (Shopify, Etsy, Square, Faire, etc.) at your option. You authorize TMW to access data from those platforms on your behalf when you connect them. You are responsible for compliance with each third-party platform's terms.
8. Communications
By creating an account, you consent to receive transactional communications (account verification, security alerts, billing notices) by email and SMS. Marketing communications are opt-in only and managed in your account settings. SMS messages are subject to standard message and data rates. Reply STOP to opt out.
9. Privacy
Your use of TMW is also governed by our
Privacy Policy, which is incorporated by reference.
10. Multi-tenant data isolation
TMW is built so that no other user, market, or even our internal staff can read your data without your explicit consent. Your maker profile data is shared with a market only when you submit an application or accept an invitation from that market. We make this commitment as a matter of architecture, not just policy.
11. Service availability
We provide TMW on an "as-is" and "as-available" basis. We do not guarantee uninterrupted or error-free service. Scheduled maintenance and unplanned downtime may occur.
12. AI features
TMW may include AI-assisted features (application drafting feedback, content suggestions, etc.). All AI features are clearly labeled. AI-generated drafts of communications affecting you are reviewed by humans before sending. You can opt out of AI features in your account settings. You retain ownership of any content you create, including AI-assisted drafts you accept. We do not use Your Content to train third-party AI models.
13. Disclaimers
To the fullest extent permitted by law, TMW is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of liability
To the fullest extent permitted by law, in no event will our aggregate liability exceed the greater of (a) the amount you paid to us in the 12 months before the claim, or (b) one hundred U.S. dollars ($100). We will not be liable for indirect, incidental, consequential, or punitive damages.
15. Indemnification
You agree to indemnify and hold harmless Company, its officers, directors, employees, and agents from any claims arising out of (a) your use of TMW, (b) Your Content, or (c) your breach of these Terms.
16. Termination
You may terminate your account at any time via your account settings. We may terminate or suspend your account if you breach these Terms, with or without notice depending on severity. Upon termination, you may export Your Content for 30 days, after which we may delete it.
17. Changes to Terms
We may update these Terms from time to time. Material changes require re-acceptance via TMW. Non-material changes will be posted with an effective date. Continued use after the effective date constitutes acceptance.
18. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
